Blazon reserves the right to change these terms at any time, effective immediately upon posting on the Blazon Website. If you violate these terms, Blazon may terminate your use of the Blazon Website and/or take appropriate legal action against you.

All rights, including copyright, in the content of Blazon web pages are owned or controlled for these purposes by Blazon Website for personal use only; provided that each user retains all copyright notices and other proprietary notices contained on or in relation to the materials included in that Blazon Website. Users may not print, copy, reproduce, download, republish, broadcast, transmit, display, modify, or re-use the materials from a Blazon Website for any other purpose, including in particular any purpose which publicly re-sells or re-uses the materials.

TERMS AND CONDITIONS OF SALES

These Terms and Conditions govern the placing of orders with Blazon Brand, LLC, (“Blazon”) doing business as Blazon Brush (“Blazon”) for the Products. Your purchase of the Product will be subject to these Terms and Conditions and the refund policy.

The purchase of the Products is subject to additional terms and conditions. These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply in the future.

These Terms of Service and any policies or operating rules posted by us on this site constitutes the entire agreement and understanding between you and us, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

None of these Terms affects your legal rights and these are not diminished in any way. If any term is held to be invalid under applicable statute or rule of law, that term is automatically omitted from the terms to minimum extent necessary to comply with the law and without affecting the validity or enforceability of the remainder

SHIPMENT

Such date is only an estimate, is subject to change, and Blazon does not represent or warrant that it will be able to ship the Product by the estimated date.  As a result, in the event that a delay arises and the estimated shipment and/or release of the product is not met, Blazon is not responsible for any damages that may occur due to the delay, nor shall it be obligated, except as set forth in these Terms, to provide any discounts, refunds or credits due to any such delays.  Shipments will be made Monday – Friday, excluding holidays, unless otherwise noted.

All prices are correct at time of display online. Shipping,  handling and taxes are in addition to the prices shown. Shipping and handling charges are based on the weight and delivery location and are recalculated for each line of the order. Delivery Charges are available for display during the initial checkout phase before any address details are entered.

Blazon Design LLC is not responsible for product lost or damaged during shipment.

Purchasers outside the aforementioned states are responsible for their state or local sales / use tax, if any, and any other taxes payable by reason of this transaction.

The goods you order will be delivered to the address you give when you place your order.

PRE-ORDER

These Pre-Order Terms and Conditions govern the placing of pre-orders (“Pre-Order”) with Blazon Brand, LLC, doing business as Blazon Brush (“Blazon”) for the Products.

Please read these Terms carefully before submitting your Pre-Order of any Blazon Products. By submitting your Pre-Order, you agree to be legally bound by these terms.

When placing a Pre-Order, you will be required to provide certain information, such as your address and billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. Blazon shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct contact or shipping information.

Methods of payment accepted are Visa, Mastercard, American Express, Discover, PayPal and others as made available from time to time by the payment gateway provider. Your placing of a Pre-Order constitutes your express agreement to the company charging of your provided payment method at such time.

The Products will be shipped in the order in which your Pre-Order is received by the Company.

In case the merchandise in pre-order fails in delivery, Blazon will promptly inform and refund customers. Blazon will not be held responsible for a delay in shipment caused by circumstances beyond the control of Blazon that cause pre-ordered products to arrive at the warehouse later than the time specified on the product’s purchase page.

In Pre-order purchases credit cards are debited at the moment the order is placed. Pre-order products that are purchased by bank transfer must be paid for within 48 hours of placing the order as stated in the bank transfer guidelines.

PAYMENT

Blazon must validate the credit card details you submit to us before your order can be accepted.

Blazon will take all reasonable care to keep the details of your order and credit card information secure. Unless it has been established that we have been negligent, Blazon will not be liable for any losses you may suffer as a result of unauthorized access by a third party to the information transmitted by you when ordering products from Blazon Brush online.

No contract exists between you and Blazon for the sale of any goods until BLazon has received and accepted your order and has sent you confirmation in writing or by email to the address or email address you have given. Once Blazon does so, there is a binding legal contract between us.  

We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made a pricing, or we are not longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable. We deliver your order right away. 

If your item is not in stock, we will back order for you. You will always be emailed with the option to cancel your order if you would rather not wait.

The contract is subject to your right of cancellation in certain cases.

You are entitled to cancel your order and return the goods within 7 working days for a full refund, including the cost of delivery. Please note that for hygiene reasons items cannot be returned if used. If the product has not been used it should be returned in its original packaging.  If products are damaged, scratched or not in their original condition or packaging, an additional fee will be charged on review.

To return items contact us by email (sales@blazonbrush.com). Your refund will be paid within 30 days. You are responsible for the cost and risk of loss or damage when returning the goods, so you should take out enough postal insurance to cover their value. This cancellation policy does not affect your rights when we are at fault – for example, if goods are faulty or misdescribed.
